Gardeners Hounslow Terms and Conditions

These Terms and Conditions set out the basis on which Gardeners Hounslow provides gardening and related services to residential and commercial customers. By making a booking, accepting a quotation, or allowing our gardeners to start work at your property, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Client means the person, company or organisation requesting the services.

Services means any gardening, landscaping, lawn care, hedge cutting, garden maintenance, clearance, waste removal, or related work carried out by Gardeners Hounslow.

Property means the outdoor or garden area at which the Services are performed.

Agreement means the contract between Gardeners Hounslow and the Client made up of these Terms and Conditions together with any written quotation or confirmation of booking.

2. Scope of Services

Gardeners Hounslow provides gardening and garden maintenance services within its usual service area, which includes Hounslow and surrounding locations. Availability of Services may vary depending on staff, equipment and seasonal demand.

The specific Services to be provided will be agreed between Gardeners Hounslow and the Client, either in a written quotation, a booking confirmation, or as otherwise agreed in writing before the work begins. The Client is responsible for ensuring that the description of Services is complete and accurate.

Any additional work requested by the Client that falls outside the original scope of Services will be treated as a variation and may be subject to additional charges, revised timescales and separate agreement.

3. Booking Process

To request an appointment, the Client may contact Gardeners Hounslow and provide details of the required Services, the Property address, access arrangements and any relevant information about the condition of the garden.

Gardeners Hounslow may offer an estimate based on the information provided or may arrange a visit to assess the work before issuing a quotation. All quotations are based on the information and access provided at the time. If this information is incomplete or inaccurate, Gardeners Hounslow reserves the right to amend the quotation or apply additional charges.

A booking is not confirmed until Gardeners Hounslow has issued a confirmation to the Client and, where required, the Client has accepted the quotation and paid any applicable deposit. Gardeners Hounslow may decline a booking at its discretion.

The Client must ensure that someone with authority to agree to the work is available to meet the gardening team on the first visit where necessary, to confirm the scope of Services and any practical details such as access, water supply and power supply.

4. Access to the Property

The Client is responsible for providing safe and reasonable access to the Property for Gardeners Hounslow and its staff, vehicles and equipment at the agreed time. This includes ensuring that gates are unlocked, access codes are correct and any parking restrictions are communicated in advance.

If access is not available at the arranged time, Gardeners Hounslow may charge a call-out fee or the full amount of the scheduled visit, at its discretion. If a return visit is required due to lack of access, this may be chargeable as an additional visit.

The Client must inform Gardeners Hounslow in advance of any hazards at the Property, including uneven ground, exposed wiring, ponds, loose paving, dangerous dogs or other risks that may affect health and safety.

5. Client Responsibilities

The Client must ensure that:

The garden area is reasonably tidy and free from household rubbish, large obstructions, pet waste and hazardous materials before the gardeners arrive, unless garden clearance has been specifically included in the Services.

Children and pets are kept away from the working area for the duration of the visit, and any equipment or products used are not interfered with after the team has left.

Any required permissions, consents or approvals from neighbours, landlords, freeholders or local authorities are obtained before work starts, particularly for boundary hedges, tree works or substantial landscaping.

6. Pricing and Quotations

Prices may be given as an hourly rate, a fixed price for a specific task, or a regular maintenance charge. Unless stated otherwise, all prices are quoted in pounds sterling and are exclusive of any applicable taxes or disposal fees.

Quotations are based on the condition of the garden and information available at the time of quotation. If, on arrival, the garden condition differs significantly or additional work is required, Gardeners Hounslow may revise the quotation or charge for the extra work at the current applicable rates.

Unless otherwise stated, quotations are valid for 30 days from the date of issue, after which they may be subject to change.

7. Payments and Invoicing

Payment terms will be confirmed at the time of booking. Gardeners Hounslow may require full payment in advance or a deposit before starting the Services, particularly for larger jobs or projects requiring materials or equipment hire.

Where payment is due on completion of the visit, it must be made promptly using the methods accepted by Gardeners Hounslow. For regular maintenance contracts, the Client may be invoiced on a per-visit, weekly, monthly or other agreed basis.

All invoices must be paid by the due date shown. If payment is not received on time, Gardeners Hounslow reserves the right to suspend further Services, charge interest on late payments and recover any reasonable costs incurred in pursuing payment.

The Client must raise any queries about an invoice as soon as reasonably possible and no later than seven days after the invoice date. Disputes about part of an invoice do not entitle the Client to withhold payment of the undisputed part.

8. Cancellations and Rescheduling

The Client may cancel or reschedule a booking by giving Gardeners Hounslow reasonable notice. Unless otherwise agreed in writing, at least 24 hours notice is required for cancellation or rescheduling of standard visits.

If the Client cancels or reschedules with less than the required notice or fails to provide access at the agreed time, Gardeners Hounslow may charge a late cancellation fee up to the value of the scheduled visit to cover lost time and costs.

For larger projects or works requiring special materials or equipment, a longer notice period may apply and this will be confirmed when booking. If such work is cancelled after materials have been ordered or delivered, the Client may be required to pay for those materials and any non-refundable costs incurred.

Gardeners Hounslow may cancel or reschedule a booking due to adverse weather, staff illness, safety concerns or other circumstances beyond its reasonable control. In such cases, Gardeners Hounslow will aim to offer an alternative appointment time as soon as reasonably possible.

9. Weather and Seasonal Conditions

Certain gardening tasks are weather and season dependent. If, on the day of the visit, conditions mean that some or all of the planned Services cannot be carried out safely or effectively, Gardeners Hounslow may adjust the work plan, perform alternative suitable tasks, or reschedule the visit.

Gardeners Hounslow is not responsible for delays or changes to plant growth, lawn health or garden appearance caused by extreme weather conditions, drought, flooding, heatwaves, frost, or other environmental factors beyond its control.

10. Materials, Plants and Products

Where Gardeners Hounslow supplies materials, plants or products as part of the Services, these will be of reasonable quality and suitable for the intended purpose based on the information available.

Living plants, turf and seeds are naturally variable and subject to environmental conditions. Gardeners Hounslow cannot guarantee the long-term survival or performance of plants once they have been installed, as this depends on factors such as ongoing care, watering, soil conditions, pests and diseases, and weather.

Any manufacturer warranties on products or equipment used will be passed on to the Client where applicable, and the Client must contact the manufacturer direct in respect of such warranties.

11. Garden Waste and Waste Regulations

Gardeners Hounslow will handle garden waste in accordance with applicable waste regulations and local requirements. The approach to waste will be agreed with the Client when arranging the Services.

Unless expressly included within the quotation, the price for Services does not automatically include removal and disposal of green waste or other rubbish from the Property. Where waste removal is included, any limits on volume or weight will be stated or reasonably implied.

If the amount of waste exceeds the agreed allowance or the original estimate, additional charges may apply based on the type and quantity of waste and any disposal fees. Gardeners Hounslow does not remove hazardous or controlled waste, including but not limited to asbestos, chemicals, paint, tyres, electrical items or clinical waste.

Where agreed, garden waste may be left on site in an appropriate place, such as a compost area or green waste bin, subject to the Client having suitable space and permissions. The Client is responsible for any council collection arrangements and fees relating to bins at the Property.

12. Health and Safety

Gardeners Hounslow takes reasonable steps to ensure the health and safety of its staff, the Client and third parties during the provision of Services. This includes using appropriate equipment, following safe working practices and complying with relevant regulations.

The Client must support these arrangements by keeping children, pets and visitors away from the working area and by following any safety advice given by the gardeners, including regarding the use of treated areas, chemicals or equipment after the visit.

13. Liability and Limitations

Gardeners Hounslow will exercise reasonable care and skill in providing the Services. If damage is caused to the Property as a direct result of negligence while carrying out the Services, Gardeners Hounslow will, at its option, repair the damage, pay for the reasonable cost of repair, or provide a reasonable reduction in the price.

Gardeners Hounslow is not liable for any pre-existing damage, defects or weaknesses at the Property, including but not limited to loose fencing, unstable walls, old paving, defective pipes or poor wiring that may be affected by normal gardening work.

Gardeners Hounslow will not be liable for loss or damage arising from factors outside its reasonable control, such as extreme weather, subsidence, structural movement, pests, diseases, or actions of third parties.

Gardeners Hounslow will not be responsible for any indirect or consequential losses, including loss of enjoyment, loss of use, loss of profit or loss of anticipated savings.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or any other liability that cannot be limited or excluded by law.

14. Complaints and Quality of Service

If the Client is dissatisfied with any aspect of the Services, they should raise the issue as soon as possible, ideally within 24 hours of the visit, so that Gardeners Hounslow can investigate and, where appropriate, put things right.

Gardeners Hounslow may request photographs or a visit to inspect the issue. Where there is a justified complaint, Gardeners Hounslow may, at its discretion, re-perform the Services, offer a partial refund or make another reasonable remedy.

15. Termination of Ongoing Services

For regular maintenance arrangements without a fixed term, either party may terminate the Agreement by giving reasonable notice, usually at least 14 days, unless a different notice period has been agreed in writing.

Gardeners Hounslow may terminate the Agreement with immediate effect if the Client fails to pay sums due, repeatedly cancels at short notice, refuses reasonable access, breaches these Terms and Conditions, or behaves in an abusive or threatening manner towards staff.

16. Privacy and Data Protection

Gardeners Hounslow will collect and use personal information provided by the Client, such as name, address and contact details, only as necessary to manage bookings, provide the Services, issue invoices and communicate with the Client.

Personal data will be handled in accordance with applicable data protection laws. Gardeners Hounslow will not sell or share personal information with unrelated third parties for marketing purposes without consent, except where required by law.

17. Changes to These Terms

Gardeners Hounslow may update or amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking. For ongoing maintenance arrangements, any material changes will be communicated to the Client, and continued use of the Services after notification will constitute acceptance of the updated terms.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or connected with these Terms and Conditions or the Services, except that consumers residing elsewhere in the United Kingdom may have the benefit of any mandatory legal protections available in their home jurisdiction.

19. General Provisions

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

No failure or delay by Gardeners Hounslow in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy.

The Agreement is between Gardeners Hounslow and the Client. No other person shall have any rights to enforce any of its terms.
